Sports Betting Set To Become Legal Across Us After Supreme Court Decision

Casinos in the traditional gambling town can legally open sportsbooks. By law, that new rule also allows tribal casinos across the state to open sportsbooks. The Land of Enchantment was the sixth U.S. state to offer legalized sports betting.

Over half the states have now passed legislation legalizing sports betting. The majority of these states have already launched online or retail betting markets, while others are in the process of finalizing rules and regulations. States can legalize sports betting if they choose after the US Supreme Court struck down the federal ban on single-game wagering in 2018. Interest in the legalization of sports betting was ramping up in the US in recent years, even prior to that decision. In 2020, voters in 55 of the state’s 64 parishes supported legal sports betting, including all those around New Orleans, Baton Rouge and Lafayette. New Jersey, the state to bring the sports gambling case to the Supreme Court, is now enjoying the fruits of its labor.

Overall, the repeal of PASPA has been great for sports betting and saw over half of the country move forward with sports betting in under 3 years. On Tuesday, Maryland Gov. Larry Hogan signed into law a bill legalizing sports betting, making it the 28th state to legalize wagers on sports in the country, according to the American Gaming Association. In Florida Wednesday, lawmakers approved sports betting in a move that is expected to see legal challenges. One of the largest impending sports markets in the United States, Florida could launch sports betting as soon as October 15.

Sports bettors place their wagers either legally, through a bookmaker/sportsbook, or illegally through privately run enterprises. The term “book” is a reference to the books used by wage brokers to track wagers, payouts, and debts. They take bets “up-front”, meaning the bettor must pay the sportsbook before placing the bet. Illegal bookies, due to the nature of their business, can operate anywhere but only require money from losing bettors and don’t require the wagered money up front, creating the possibility of debt to the bookie from the bettor. This creates a number of other criminal elements, thus furthering their illegality.

Legislation was passed in June to allow sports gambling, though in-state collegiate games will be off-limits under the new law. It will make gambling lawful in a variety of locations both in-person and online. A proposed bill was introduced this April that would create an Alabama Sports Wagering Commission to oversee the regulation of sports betting in the state. Under the proposed bill, bettors would be able to gamble on pro and college sports.

Amendments to the state constitution’s sports wagering prohibitions would have resulted in a 2022 ballot referendum. The latest sports betting blow likely dashes hopes for legalization until 2025 or later. House Bill 241 is comparable to Koenig’s earlier sponsored legislation. Details include the Kentucky Horse Racing Commission would regulate the allowance of sports wagering at Kentucky tracks and betting.
